Scope and acceptance<\/h2>\n

These General Terms and Conditions of Sale apply to all orders placed by the Customer on the website (udiag.eu<\/strong>), as well as all pre-orders and quotations drawn up by GREEN MOTOR COMPANY<\/strong> to meet an order.<\/p>\n

These General Terms and Conditions of Sale are written in French in their original version, which alone is authentic and prevails over any other version. They apply to the exclusion of all other conditions.<\/p>\n

These General Terms and Conditions of Sale are accessible by the Customer on the website at all times and are systematically submitted to the Customer before any order is placed and before any user account is created on the website.<\/p>\n

The Customer declares that he\/she has read and accepted these General Terms and Conditions of Sale without reservation before placing an order on the website.<\/p>\n

In the event that any of the clauses stipulated herein are deemed inapplicable or unenforceable by a court decision, the other provisions shall remain in force and remain fully applicable.<\/p>\n

The Customer acknowledges that due to possible changes to the website, GREEN MOTOR COMPANY<\/strong> reserves the right to adapt or modify these General Terms and Conditions of Sale at any time. Consequently, GREEN MOTOR COMPANY invites the Customer to consult the GSC before any new order.<\/p>\n <\/div>\n <\/div>\n\n \n

Ordering and payment<\/h2>\n

Orders are placed from the catalogue of products available on the website at the prices indicated on the website. Any order implies acceptance of the description of the products and the prices in force on the day of the order.<\/p>\n

The prices indicated on the website are in euros and include all taxes (they take into account the VAT rate in force for France on the day of the order), excluding delivery costs, which are in principle payable by the Customer. Promotional offers are only valid within the double limit of the validity period of the offer concerned and available stocks.<\/p>\n

As soon as an order has been registered, the Customer will receive a detailed acknowledgement of receipt of the order at the e-mail address previously provided.<\/p>\n

GREEN MOTOR COMPANY<\/strong> undertakes to honour online orders only while stocks last. The Customer acknowledges that placing an order does not guarantee the availability of the product ordered. If a product is not available, GREEN MOTOR COMPANY will inform the Customer by e-mail or telephone and the Customer will have the choice between cancelling or modifying the order.<\/p>\n

The Customer pays for his order by bank card or any other means of payment offered when placing the order. Payment in the sense of the present article is constituted by the funds actually being made available to GREEN MOTOR COMPANY.<\/p>\n <\/div>\n <\/div>\n\n \n

Delivery<\/h2>\n

Delivery is made in mainland France and in the European Union to the address indicated by the Customer at the time of ordering. For orders outside these territories, please contact GREEN MOTOR COMPANY at contact@udiag.eu<\/a> or to +33 6 50 93 02 30<\/a>.<\/p>\n

Delivery costs will be invoiced to the Customer at the rate in force on the day of the order.<\/p>\n

Delivery times are indicated on the website when the order is placed and may vary depending on the delivery method chosen. If several items are ordered at the same time, GREEN MOTOR COMPANY<\/strong> reserves the right to deliver the order in several instalments. Delivery times are estimates only and failure to meet them shall not give rise to the payment of any compensation whatsoever.<\/p>\n

The Customer is required to check the condition of the packaging and the conformity of the order at the time of delivery and must immediately inform the delivery agent of any reservations he may have regarding the condition of the order. In the absence of notification to the delivery person or to GREEN MOTOR COMPANY upon receipt, the delivery will be deemed accepted without reservation by the Customer.<\/p>\n

In the event of a justified report, the Customer may return the order according to the terms and conditions set forth in GREEN MOTOR COMPANY's Return Policy. Any order returned without GREEN MOTOR COMPANY's agreement will be refused and returned to the sender at his expense and risk. To be validly returned, the delivered items must not have been used and must be returned intact in their original packaging with their accessories, user manuals and documentation.<\/p>\n <\/div>\n <\/div>\n\n \n

The Customer guarantees that all the information provided at the time of ordering, or when registering for a user account, is complete and accurate and corresponds to the Customer's actual situation at the time of ordering. Consequently, the responsibility of GREEN MOTOR COMPANY<\/strong> cannot be held liable for any damage resulting from incomplete or inaccurate information provided when the order is placed.<\/p>\n

GREEN MOTOR COMPANY<\/strong> reserves the right to correct any errors, inaccuracies or omissions, and to change or update the information published on the website, or to cancel orders if any of this information is inaccurate, at any time and without prior notice.<\/p>\n

The responsibility of GREEN MOTOR COMPANY<\/strong> shall not be held liable for any damage resulting from the illegal or improper use of a product ordered on the website.<\/p>\n

The responsibility of GREEN MOTOR COMPANY<\/strong> shall not be held liable for any breach of its contractual obligations resulting from an act of God or force majeure, including, but not limited to, natural disasters, fires, internal or external strikes, internal or external failures or breakdowns.<\/p>\n

The Customer has no intellectual property rights over the products, packaging or wrapping relating to orders placed with GREEN MOTOR COMPANY<\/strong>, is the sole owner or licensee of these rights.<\/p>\n

Any use by the Customer of the intellectual property rights of GREEN MOTOR COMPANY<\/strong>, or any infringement of the intellectual property rights of its suppliers and manufacturers, is strictly prohibited, except with the express prior consent of GREEN MOTOR COMPANY.<\/p>\n <\/div>\n <\/div>\n\n \n

These General Terms and Conditions of Sale are governed by French law, to the exclusion of any international agreement.<\/p>\n

In the event of a dispute relating to these General Terms and Conditions of Sale, the parties will try as far as possible to resolve their dispute amicably.<\/p>\n

Legal guarantees<\/h3>\n
\n

The consumer has a period of two years<\/strong> from the date of delivery of the goods in order to implement the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.<\/p>\n

The legal guarantee of conformity gives the consumer the right to repair or replace the goods within a period of thirty days<\/strong> following his request, free of charge and without any major inconvenience for him. If the goods are repaired under the legal conformity guarantee, the consumer benefits from a six-month extension to the initial guarantee.<\/p>\n

The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund on return of the goods, if: (1) the trader refuses to repair or replace the goods; (2) the repair or replacement takes place after a period of thirty days; (3) the repair or replacement causes a major inconvenience to the consumer; (4) the non-conformity of the goods persists despite the attempt to bring them into conformity.<\/p>\n

Consumers also benefit from legal guarantee against hidden defects<\/strong> pursuant to articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept or to a full refund in return for the return of the goods.<\/p>\n

Articles L. 217-1 to L. 217-32 of the French Consumer Code. Any seller who obstructs the implementation of the legal guarantee in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10 % of average annual sales (article L. 241-5 of the French Consumer Code).<\/em><\/p>\n <\/div>\n\n

Right of withdrawal<\/h3>\n

In application of article L.221-28 4\u00b0 of the French Consumer Code, the consumer Customer shall will not be able to exercise his right of withdrawal<\/strong> for any order for a used or activated product that will require a new activation code to be reset, and will therefore be considered damaged.<\/p>\n <\/div>\n

Consumer Customers who have not used or activated the product ordered may exercise their right of withdrawal as follows:<\/p>\n

You have the right to withdraw from this contract without giving a reason within fourteen days<\/strong>. The withdrawal period expires fourteen days after the day on which you, or a third party designated by you, takes physical possession of the goods.<\/p>\n

We will make the refund using the same payment method as that used for the initial transaction.<\/p>\n
